NY High Court Rejects Marriage Equality
July 6, 2006
ALBANYThe New York Court of Appeals, that state's highest court, rejected full marriage equality in a 4-2 decision. We hold that the New York Constitution does not compel recognition of marriages between members of the same sex. Whether such marriages should be recognized is a question to be addressed by the Legislature,
the court stated.
The court's decision in Hernandez v. Robles, is available online (PDF).
The New York court decision is not expected to have an effect on the New Jersey Supreme Court decision in Lewis v. Harris, which is expected shortly.
