NJ Supreme Court Among Three Considering Marriage

TRENTON—New Jersey is one of three states in which the highest court will be considering the question of marriage equality.
Among the many cases the New Jersey Supreme Court will be hearing in its upcoming term, which began September 12, is the case of Lewis v. Harris, in which seven same-sex couples have alleged that the state's marriage laws are unconstitutional under the New Jersey Constitution. The case was appealed from an 2-1 Appellate Division decision [pdf] that rejected the couples' claims that the marriage laws violated their right to equal protection and privacy. No date has been set for oral arguments in the case.
Other states considering the question include New York, where oral arguments will be heard in the appeal of an earlier trial court decision in the case of [pdf] that the state's ban on same-sex marriage licenses violates the New York Constitution.
In addition, a decision is expected sometime soon from the Washington state Supreme Court, which heard oral arguments on the appeal of that state's marriage ban in March. Anderson v. Sims more...
